  • Who is the legal owner of H1B petition?

    Hi,

    I have resigned Company A and joined Company B. Company B has processed my change of employer and also got the approved I-797. As I am no longer working with Company A, he is asking me to submit the original petition papers (previous I-797) which was processed by him. Company A was my H1B sponsor.

    Do I need this documents at any point of time in future?
    Do I need this documents to claim the out of USA year once my 6 year validity is complete?
    Is it OK if I gave this document to Company A and having the Xerox or scanned copy of it with me?

    For all purposes, a copy of it will suffice for you. I think your ex-employer is being a jerk. No one cares about the petition after the employee leaves the company.
