  • 240 days authorized employment period over and H1B Transfer

    Gurus,

    My I-94 and H1B expired on 01/30/2008. Extension was filed 2 months before the expiry, i.e. 11/25/2007. I am authorized to work till 09/30/2008 and this period is over. Now I cannot work until I get my H1B Extension approval.

    Problem Cause:
    1. If I continue to wait for H1B Extension to go through, should my company pay whole salary?
    2. What legal actions can I take if my company refuses to pay me.
    3. If I go out of country due to reasons said above, what are chances of rejection.
    4. Can I transfer my H1B to another employer now? What are chances of approval?

    1. No as you are not working and cannot work legally.
    2. Nothing.
    3. Approval can happen but EOS will not.
    4. No, as your I-94 expired.

    Complicated enough for you to consult an attorney.
