  • H1 still not approved

    Hello,

I've applied for fresh H1 this year and my name got selected in the lottery.
My case was sent to the USCIS on May 06 2008 but still it's not approved.
When I go tot the USCIS website, the case status is pending.

I heard that on or before Oct 01, all the H1 visa gets approved / rejected.
    My case is still pending.

I got the H1 I129 receipt from the consultant just to ensure that the case number is mine.

Could you tell me what could be the reasons ?

    Thanks.

How do you know if you are checking the status of "your" H1? The H1 receipt does not have any name on it, AFAIK.

A shady employer might be the reason. Just my lunch time guess.

        .
The paper one does have a name to my knowledge.

The I129 receipt that the employer scanned and sent me had my name and the employers name.

I know in the USCIS website the names are not displayed.

I129 is NOT a receipt. It is the application. You need I797C to confirm if your application was really made.

Yes, the name of the form is I797C.
I got the scanned copy from the employer. It shows my name and the petitioners name.

Could you answer the question now ?

              Thanks.

Nothing more to add. Employer credentials or background check could be reasons for delay. No rule that says all H1bs should be approved by Oct 1st.

My h1 did not come until Feb next year, when it was applied for in April. Are you on OPT? Be patient, it will come.
