Sir/Madam,
I came to this country in H4 visa in March 2006.
I Filed for H1B in April 2007 and got it approved in oct 2007.
There was an error in my name printed on the Form I-797 Notice of Action
My first name is printed as last name and my last name is printed as first name. Due to this problem I am not able to get a Social Security Number aswell.
I have made multiple appeals to the USCIS through my Employer but still my name change is not yet done.
Due to some urgency I have to go to India for 6 weeks in the last week of Dec 2008.
Here are my questions
If my name change correction is not done till then.
1. Can I leave this country and get my visa stamped in the US Counsellet General in INDIA with the mispelled name.I donot have an SSN .
OR
2. Can I get my visa stamped as H4 along with my husband who has an H1B , since my previous status was H4.
If i can get my visa stamped as H4 along with my husband , After coming back to USA, Can i change my visa status to H1B .
