travel with H1B petition expiring date near

HI.
iam in usa,my H1B petition expires in may-2009, Can i travel to india in feb or march?. on my accosaion of marriage..and i need to bring my wife along with me..
is there any risk involved in getting H4 or while coming back at port of entry?

No risk. You just have to have your employer file for an extension for both of you immediately upon re-entering.

The H4 visa validity will be for a short period. Not a risk though.
