H1B Petition Status Still Pending

Hi,

My husband had applied for his H1 B this year 2008 and after a wait of 3 months the case status changed from "Case Pending" to "Request for additional Information". We contacted the contractor and he mailed the required document within 2 weeks and now the case status is "Response to request for evidence received, and case processing has resumed" but its more than a month now and no change in the case. Its now November. Can you please advice how long would it take for them to change the status?

God Knows

No one can say / repdict how much time USCIS will take to process the case. Uscis site says it to be 60 days. But this need not always be true

I have read in couple of other forums where the petitions are approved even in Feb for those that are applied during previous year April. So it is matter of wait and watch. Good Luck.....

Will expedite work???

Can we apply for an expedite/permium processing to know the status fast? Please advice

Yes, you can upgrade, now that you answered RFE and case processing has resumed.

Any idea how do we do that? and wont it create any bad impression kinda why we need to expedite. Please advice

Ask your employer or attorney. What bad impression? They will happily take your $1k and within 15 days give you a decision - approval/denial/RFE whatever...

Will there be a case that when an application is selected under the H1B lot that there is a possibilty of Petition Rejection before the visa interview?? Please advice
