  • hypothetical 221g question

I am stuck with 221g (Chennai) due to TAL for the second time in as many years. I just heard from one of my friends that had I gone to Canada for my stamping and gotten a 221g there, I would have been allowed to return to the US with my new I797, employment letter etc. Is this true? Any risks involved here?

If your visa expired, they will not allow you to even board the plane. You could have done it if your visa was valid. There were instances in Canada where the VOs give some sort of parole document to allow a person to enter for 30 days temporarily. If the visa is pending past that, they would have to go back as the I-94 is issued only for 30-60 dyas.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

I know a person who (just like I) had a valid unexpired Visa and was allowed back to the US by road. But I remember that when I went for stamping in Chennai, the VO put a seal on (I guess for cancelling) my existing valid Visa. Not sure if the same thing (cancelling my existing valid visa) would've happened in Canada as well, in which case I would not have a valid visa for re-entry.
