  • H1B to L1 . . . Back to H1?

    Hi,

I had my H1B approved in 2006, but came to US only in 2008, when the H1B was expiring. Applied for H1 extension but got a denial. So I went back to India and came back on a L1. Now what is the status with my H1? If I find a new employer, can I still use the same H1?

    Yes, provided USCIS approves it.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

      Hi,

I have a similar case. On an H1 from 2004-2007. Then when H1 was expiring my company filed for a COS and I am on L1A now.

Question - Can I search for a new job and my new employer would file for a COS and I go back to H1 and then they hire me?

      Thanks
      Abhi
