Regarding H4 stamping

Hi,

I came to usa in 07 on H1 through company A with valid stamping till apr 09. I shifted to company B in same year october 07. I went on vacation to get marriage to india, unfortunately it took 4 month to get marriage. I took 4 months vacation. I came back usa alone now I am searching for assignment. If I want to send my wife for H4 stamping do I need recent pay stubs?
I have 2007 filing and 08 pay stubs till sept. I got marriage on Dec 13th.

Please advise me.

dude,

you are out of status then how can you can get your wife on H4. Do you think it is india where you can violate major immigration law and won't be punished for it.
If you want your wife back in the USA then you need to file WH4 against your employer to get back in status. Once you are back in status then you can sponsor your visa on H4.
You cannot fool the consulate people. They would need your W2s and they would come to know in a minute that you were not paid according to the LCA.
