    Hi,

    I had my H1-B filed with company A and now its transferred to company B. My wife and first child has the H4 stamped on their passports. My second child is born in recent months who needs the H4 so I am submitting my new H1-B(I-797) approval with all the required docs.
    My question is as my wife and children are in India and I am residing in USA, they will be coming to USA once my 2nd child passport is stamped with H4. Will the POE(port of entry) question for my wife's and 1st child's visa as its filed by company A?
    If I go to India, will I require to get my H1 stamped again with new I-797 approval before coming back to USA?

    Kindly reply at the earliest.

    Yes,
    anytime u cross US boundaries u wud be asked for showing ur passport n visa. If u r asked for latest paystubs, u r DEAD! secondly, if ur old employer files for cancellation of ur H1 status after u resign, u r DEAD

        No new visa stamp is needed for anyone as long as the previous H1b visa is valid. It is valid even if your old employer cancels the petition.

        You carry new employer's approved I797 and everyone can travel without problems as long as you are maintaining proper status and getting paid.
