  • H1B Stamping (Currently in US)

    My friend's status changed from OPT to H1B (I-797 Received). She graduated with a Master's degree from the US an year ago and has been working for client through a consultant (employer) for an year now. Her project is ending in less than a month after which she will technically still be employed as she is with a consultant but actually will be on the bench till she finds another project. She desperately wants to come to India for a holiday. Is it safe to come to India for stamping during this interim period between projects? Is a client letter important? Is anyone else in the same situation?

    Every H1b holder needs to be paid all the time even on bench. That is the law. H1b requires a person to hold a job and if the person has no project, it will be tough to get a visa.
