I was holding a H1 visa stamped by employer A in 2006, which expired in 2008. I was in US only for few months in 2006. Right now I'm on H4. One of the consultancies say that after I get a project, they can file a new H1 which doesn't fall under the quote(April). Also it takes 2 weeks for the H1 processing.
As the H1 quota is valid for 6years and also I have spent only few months in US, I have 3 more years left in the quota and my H1 would not fall in the new quota.
Is this correct? If anyone has any thoughts on this, please share it.
