    hi all,

    Iam in US on H4 visa.I want to get H1 visa.
    what is the difference between H1b filing and H4 to H1b transfer?
    What is the proceedure for both?
    How much we will have to spend for each?
    Which is preferable?

    Please somebody guide me..

    ---- First stop writing in big bold letters. Everyone is reading your post. Those who would like to respond will do so unhesitatingly

    ---- H1 filing is applyiong for a fresh H1 with a new employer who is willing to sponsor you and offer a job to work for their company and pay you

    ---- H4 to H1 is Change of status (COS) provided the above conditions are fulfilled. In either case it is a new application

    ---- The only difference is that on H4 you are in US and applying for COS. While for H1 alone you be outside the country and if a company is willing to sponsor you they can do it

    ---- The application procedure for both is the same. If you have a H4 you submit the details of your H4 for a COS

    ---- The expenses in either case are borne by the employer. If you pay any amount and if the employer is demanding any amount then that becomes an illegal activity

    ---- If you are on H4 you will be applying for a COS anyway

    ---- The other option of applying H1 only is when you have not come to the US on a visa like H4

      Why? Can also be applied as a CP case if the I-94 is not submitted.
