need urgent help+status issue

hello

My husband got laid off today. Till Today my husband was on h1 & i was on H4. I'm considering to study RN for myself(Associate in nursing) in Fall 2009.
so I want to apply for F1 visa for myself and F2 for my husband.

Do you think our visa will be approved? or is there any risk because study is associate degree ?
2. also can we stay in US all this time? from feb '09 to Aug '09 once I apply for COS to F1?

3. Any other suggestion for similar situation

Your F1 for associates degree in fall 2009 is too far away and it will not cover the status gap for you and your husband as H1b loses status the day of layoff as per the books.

F1 approval for associates degree outside the US will be tough in terms of visa.
