  • L1 to H1 with COS, L1 expires in July

    My L1-A expires in July 2009 and I am planning to apply for fresh H1-B with Change of Status with another employer. My current employer is filing for an extension in Apr 2009.

    1. Will my COS be rejected because of I94 expiring in July 2009?
    2. Luckily if I my L1-A extension is filed before May 2009,will the INS take into consideration my extension and provide me COS?

    You need to apply Premium Processing for your L1 A or apply for extension right away if you want to be in status when they adjudicate your L1 to H1 COS.

      2. Not unless they request an RFE to prove your stay past the initial I-94 expiry.
