H1 extension and end of project

Hello,

A friend is working on H1 for an Indian company.
His first phase of H1 will end in April 26 2009. He has got his extension filed last month itself.

Now due to maret condition, his project is getting over on April 3 2009.
The company says, if they cannot find any project for him, he has to leave US by April 10 2009.

Questions are:

1) If they ask him to leave, will it hamper his H1 extension that is already pending with USCIS ?

2) If they ask him to come back, say in Aug 2009, can he use the current H1 (if extn is approved), stamp it and come back ?

3) What are the risk factors involved ?

1. Yes and No. The extension of stay term applies only when one is inside US. But if he has time left from the 6 year term, it can be used later on with any employer. Read the FAQs.
