    Hi,

    My friend has a strange situation, I want you to please give in your inputs. His 6th year is expiring by Sep 2010 and he is applying for his GC right now. But applying proccees (placing the ad in the newspaper is in progress right now) is currently going on and i think it will take another 6 months to apply for labour.

    My question is that is there a timeframe before which labor has to be applied for extending the H1 after Sep 2010 (6years)? like i heard some one say that labor has to be applied before 1 year of H1 expiration - is this true?

    Secondly, should the labor be approved for H1 extension or just applying labor before expiration is fine?

    What you heard is true. It has to be applied 365 days prior to H1b 6 year expiry to get extensions past the 6th year.
