  • H1-B transfer

    Hello,

    I am on a non-cap H1-B visa, working in clinical research. This H1 expires in August. I have not yet got the H1 stamped. I am joining residency in internal medicine in July. I can apply for H1(non-cap too) here only after I get my medical licence, which can take about a month. I am planning to go to India, but in a dilema when to go. Should I go now and come back on my present H1in june and transfer later, or should I go once I get my new H1. If I plan to come back on my present H1, its only until August ,will that be a problem. There is possibilty that my new H1 process can be delayed and I don't get a chance to go to India before joining residency. Please help me with your suggestions.

    You should go now, return on existing H1b, file for a H1b transfer to the residency program.
