Do i need my paystubs for H1 to H4 transfer/

Hi,

I have a quick question

I was on H1 B and got laid off in Dec08.
My employers still kept me on H1 without generating paystubs and then i got my H1 denied in apr 09 and i left US in May first week.
Now i wanna apply for H4 from India.
I do not have my paystubs after Dec 08.
Will that cause a problem.

Please help.

--- There is a disconnect here. How was your H1B denied when you were in the US. Please clarify for a better answer.

Now i wanna apply for H4 from India.
I do not have my paystubs after Dec 08.
Will that cause a problem.

--- Your H4 visa stamping will primarily depend on the H1B holder's documents. Yes, it could be an issue if the VO asks for proof of your H1B stay, but historically looking at forums and experiences of people in similar situation like yours, H4 stamping depends on the primary H1B holder's documents.

I went to US on H4 in 2006 and got transferred to H1 B in oct 2007.I started working for employer A and later moved to employer B.I transferred my visa in Aug 08 but got an RFE in Dec 08.After that i lost my job in Jan 09 .My case was pending and i was on bench from Jan till Apr.My transfer got denied in Apr after being pending for 8 mnths.So ireturned back to India and now i want to apply for H4.
So can you tell me if i would need my paystubs for the H4 visa.

--- Since you were legally allowed to work until the day of your H1B transfer denial, technically you are required to have paystubs to show your legal H1B status until April.

But again, your H4 visa stamping is totally dependent on the primary H1B holder's documents, the Visa Officer's discretion and your luck on the day of your H4 interview.
