  • 1-94 expired but H-1B renewal still pending

    Hi (first time posting)

My 1-94 is due to expire at the end of the month and my H-1B renewal is still pending (with USCIS since June 11th and will prob not be ready till August 11th). Does anyone know if I need to leave the country on the date that my 1-94 will expire? Is it ok to stay in the US until the paperwork is through? If the paperwork is still not through when I leave the US on August 13th to attend a family event I would have to hand in the expired 1-94 - would this come against me in the future when I apply for a green card?
    Thanks very much

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Thanks so much as I was really worried that I was jeopordizing any future green card application by remaining in the US on an expired 1-94
