I worked on H1-B and got laid off this March. I filed the H-4 petition and got the approval doc I797A at end of May. With no knowledge of the ongoing H-4 status at that time, my current employer filed a form I129 to transfer my previous H1-B. Now I got the mail that says the USCIS received my H1-B petition.
So right now I have:
1. Form I797A, Approval document of H4 visa. Case type: I539 Application to extend/change nonimmigrant status
2. Form I797C, Notice confirms USCIS received H1-B petition. Case type: I129 Petition for a nonimmigrant worker
My questions:
1. What is my current visa status? H4 ? or H1-B pending?
2. Is the H1-B petition (attempt to transfer H1-B to new employer) still good now that the H4 got approved?
3. Should I cancel the H1-B petition (if there's a way to do it) and then do it all over again to transfer from H4 to H1-B?
I really appreciate any assistance or guidance on this issue.
