  • COS, H1 b to F-1

I am working full time with big health system on H-1 B with play slips and everything and I applied for admission in to PhD program, fall 2009 session. I have beeen accepted with a grant to support me. The problem is I can't start till april 2010, due to personal reasons. The university has agreed to defer admission to Jan 2010 session and the guide has agreed to let me start in April 2010. I plan to file for COS from H-1 to F-1 in December 2009. And I intend to keep working till then on my H-1B. Considering it takes 3 months for COS to process, it would take me to March 2010. I plan to join with in 30 days of COS approval. Is there something important I am missing that can create problems for me. Please, please guide me..

You should discuss the timing of COS, when to apply with the ISO. You also have a choice to get a visa stamp and enter on F1 rather than go through a COS which is uncertain in terms of timing.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
