  • H1b Cancel - Any way to verify

    Hi,

    I do have a H1b petition approved (not stamped on passport) 2 years back. In the mean time I moved to different employer. Recently I asked my filling employer (ex-employer) to give me a copy of Notice of Approval. They send me the copy but they are saying that h1b petition has been canceled.

    I do have petition number (EAC number) when i check the status on USCIS website, it give me status that "Petition approved and notice sent on particular date".

    I am confused - Is H1b petition still active (as per USCIS site) or canceled as per employer?

    You cannot trust the USCIS website as it is not 100% correct all the time. If the employer revoked the H1b, consider it revoked. However, that does not mean you cannot use the cap counted H1b that was already approved to work for another employer after a transfer. What are you trying to do?

      I got a project through one consultant, he is ready to transfer my approved petition.

      Is this possible even if original filling employer canceled the petition.

        Just to make thing more clear I am right now in US on L1 and want to change job thats why I am asking - Is it possible to use h1b petition filed by different employer (almost 3 years back) who says they canceled it around 2 years back.

            Thanks, I got the answer from faqs.

            I think you are too good.

            Just as a curiosity, (don't think I am doubting you) did you have any formal law degree or its all exp gained knowledge.
