2nd H4 Stamping alone with expired H1 visa

Hello,

My wife's and my visa expired last year, however we got our extension letters. My wife is planning to go to India alone for a visit, she will also get her H4 stamped.

One of the requirements of the H4 stamping is that it needs copy of my the principal applicant's visa, as I said earlier my visa is expired but I do have a valid extension letter. Everything else in my case is perfect, I have regular pay stubs for last one year, I am at a a client site and my company is decent.

Can there be a problem in getting her h4 stamped, we also have a daughter who is a US citizen.

Please advice.

No problem. Your H1 visa not required to get her H4 visa.

Hi,

No Issues.
Just giver her your Passport complete photocopy , new original extended I-797 and other docs required for H4 (as mentioned in immihelp list)

Do we need Original I-797 for H4 stamping? I m also in same situation. But my wife is going first time for H4 stamping. I have sent copy of pitition.

Yes, send the original I797 and copy of the I-94. visa pages(even if expired)
