  • H1b Revoking ,New H1b

    Hi,
My employer sent a letter to USCIS for revoking my H1b as i was on bench for last 2 and a half months.Last week I got a full time offer where they are taking a lot of time to tranfer my h1b.My husband is also on h1b .Should I file for my h4 dependent visa? Will it affect my H1b transfer process?
Any suggestions/advice would be greatly appreciated
    Thanks

---- You can wait till the H1 transfer takes place. However, if you are nearing 240 days or your I-94 is going to expire then think of filing for H4. later you cna do a COS to H1. In all the situations, it will take time and you have to keep fingers crossed till the process is complete

I am not sure I understand the answer you provided. How can this person wait for the H1b transfer? Looks like she is already out of status without a pay. What/How does the 240 days come into picture here? The person is not even eligible for H1b portability.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

I was on unpaid leave and my employer is willing to give a letter for the same.

You and your employer are involving in tax and immigration fraud. The right thing to do is to complain to DOL and get paid. That is the law.
