    Hi

    I am planning to resign on L1 and at the same time want to apply for change of status to H4 as my husband working on H1B. My questions are

    1. What is the best approach that I wont be out of status in transition from L1 - H4 ?
    Meaning should I resign first and apply COS or vice versa.

    2. If by any chance H4 gets denied and I have already resigned from L1 employer, what are my options ?

    1. Apply COS first and resign anytime between applying and COS being approved.
    2. There should be little possibility for COS to H4 getting denied unless the H1b holder is out of status or if the application was messed up.
    If you resign and COS gets denied, you have to leave the country immediately, apply for a H4 visa and re-enter.
