H1B Transfer After 6 years

  • H1B Transfer After 6 years

    H1B first stamp May-2004 (Employer A)
    H1B second approval June-2006 (Employer B)
    Filed I485 on July 2007 ( Through Employer B, PD - Nov 2006 )
    Have EAD(valid till Oct 2010)
    H1B Extension approval June-2009 (Based on I140 - Employer B)
    Current H1B valid till June-2012

    My wife is on H4, I485 not filed for her yet.

    My question is, using AC21 can I transfer my H1B to a new employer, based on my I140?

    Possible. If you want to use AC21 for GC, it has to be the same/similar job. Talk to your lawyer about the specifics.
