hello,
I am a H1B Visa holder living in this country for the past 8.5 years. I am going to India to get married in few weeks. Here is the tricky part - my fiancee is a US citizen (she came to this country when she was 8). I want to come back into this country through my H1B Visa and retain my immigration status. I have my appointment to get the stamping done in Hyderabad. How big of an issue is the fact that she is a US citizen (I mentioned that in my DS156)? My attorney convinced me that it is not an issue as H1 Visa is "dual intent" (my company already filed for my GC and my I-485 is pending).
Should I take any specific documentation in my current situation?
Any thoughts/inputs are appreciated.
