  • H1b transfer question

    Hi,

If my h1b is due for renewal for the 2nd term in next 3 or 4 months and I transfer my h1b to a new employer, will the USCIS give a h1b for the next 3 years automatically or after I transfer my visa to new employer I still have to file for extension for the next term.

    Thanks,
    Abhishek

You don't have to file for a separate extension after the transfer. When your new company files the transfer, you will get an extension up to the project duration mentioned. If the project duration is only 1 year, then you will get it extended only for one year (not automatically for 3 years). You can file an extension again until the 6 year limit is reached.
