    hi all,
    my h1b is rejected under 221(g),i went consulate on 18th oct for first time h1b visa,the visa officer seeing my degree certificate which is non computer science said i am not eligible for the h1b and said he would send to Homeland security INS for my h1b petition revocation. mine is engineering in civil and i have 6 years of experience.
    My question is as follows
    1. How time does INS take to reply in these matter
    2. What are the chances that h1b petition is not revocated
    3. If i go again with another h1b petition what are the chances that i dont get refused again
    4. what kind of questions do they ask, if i go second time with another h1b petition.

    Same case happend with me on 31st Jan 2006. do you got any reply? or how much time it takes?

    unfortunately strange thing is happened to me on 31st of Jan 2006.

    Consulate officer submitted a request to revoke my approved H1b petition. Consulate officer gave the reason saying that my company is not paying proper wage. As there consulate officer looked at w2 form of one candidate of my employer whose income was just 1800$ for 5 months.

    When I informed the same to my employer, my employer told that there is another w2 form of the same candidate for IL state which shows the proper wage and consulate officer gave the decision without looking at that w2 form.

    So I just want to know how much time generally it takes before USCIS ask consulate officer to reconsider this H1b petition.

    Expecting a positive response.

      similar situation

      my relative also had a similar situation as mgy. he had 3 year BSc with 2 year Diploma with credential evaluation (as per h1b requirement, this is what they need for eligibility). But he was not convinced and revoked and sent back to US. on Feb 2nd 2006. we are also waiting...
