H1 CAP after revoking the old petition

Hi members

I got h1 this yr from a small indian consultant. I have not stamped the visa and never worked for him. The consultant is planning to revoke the petition due to some issues.

If he do so will I still be counted on the quota if I want to do a transfer?

If not till when I can do the transfer ? I mean for how many years this cap exemption is allowed ?
