My wife's H4 visa/I-94 expired on 26nov'2009 and I applied for H4 extension on 24november'2009 and the status is still in "Initial Review" state. On the last week of December she had to travel to india and there she visited the US consulate and got her H4 visa stamped. Now she entered US with a new I-94 based on the visa stamped.
My Question is
1. Do we have to send a letter/form for withdrawing the I539 sent in november or the request is deemed abandoned automatically as she left the country?
2. Now she is planning to change her status to F1, will there be any effect on this change (h4-f1)due to the pending EOS?
