H1B Extension

Hi,

a) I am planning to apply my extension on May 2010 and my current H1b expires on Aug 2010.Suppose if my extension got rejected say on May end 2010.Do i have to go immediately to India? or Can i stay until Aug 2010?


b) Last year i prepared my tax returns by myself.I made one mistake i have to file as non resident alien but i did it as resident alien.I come to know that recently.will that be problem for getting H1b extension.Actually i am planning to amend it later this year.

a) You could stay until Aug 2010.
b) If you're residing in US, how can you become non-resident alien?

I checked with H & R Block regarding the Tax return issue.They said it not a problem i did it correctly last year.
