Hi Everyone,
My husband went to H-4 visa stamping on Jan 31st 2019 and received 221G white slip administrative processing. Last friday (03/22/2019), his status was changed to "refused". I contacted VFS customer line and they mentioned that the visa was denied under 214(b) act - potential immigrant.
His background:
He came in 2007 for his masters and in 2009 finished his MBA. After that he joined PHD program (2010) at Tri- Valley university and after few months the university was shut down (Jan 2011).
He over stayed for about 40 days and then returned to India. In 2017, he applied for Business visa (B-1) and the consulate requested him to provide all the financial documents from the company and his company wasn't willing to provide that documentation and hencewhy his B-1 got refused.
Now, we got married on Jan 18th and he appeared for H-4 visa interview and got denial under 214(b) - potential immigrant act.
As far as I know, 214(b) is dual intent and is not applicable to H-1/H-4 visas.
Please suggest what need to be done in this case.
