University Visa Query

Hi All,

I am a Master's graduate currently on OPT with a university. My employer has agreed to sponsor my h1. Since university falls under non-profitable organization i am automatically eligible for exemption.

My question is :

1. Is it possible for me to apply for h1 under regular quota like everyone else without the exemption and still work with my university.
2. What kind of a risk would i be taking if i do so?
3. Are there any rules that bar's me from doing this?

I tried searching for answer for this question every where and ended up with nothing. Please help as i don't want to miss the visa deadline.
