I have an emergency situation. Both of my employer and I just realized that my I-94 expired 5 months ago in November, 2018. We all relied on my H1B expiration date (I-797) which is April, 2020. My attorney and employer filed a Nunc pro nunc H1B Extension immediately via premier processing. As I am now waiting for the USCIS decision, 6 month counting is coming soon. Should I leave US and go back to my home country waiting and apply H1B in US Consulate? I'd prefer not travel and stay in the US as my family already have summer plans in the US. I'm just worried what if the Nunc pro tunc does not get approved, and I am out of status for more than 6 months...Please help and share your inputs and thoughts. Thanks
