  • Wife in H4 traveling to US alone

    Hi,

    My wife and I went to India for a vacation. Got my H1B and her H4 visa approved in India. Visas valid until Dec 2010.

    I reached US last month. As my passport expired in Sept 2010, my I-94 is given validity only till sept 2010.

    My wife is arriving US in few days. Is it enough for her to carry the following documents.
    - Her passport with the visa stamp
    - Photo copy of my I-797
    - Photo copy of my passport with the I94
    - Marriage certificate

    Would she need any other documents?
    Are there any specific questions that she will be asked upon entering the US?

    Could anyone respond asap please.

    She might also require the following

    1] Your I-129 (H1B petition)
    2] Your last 2-3 months US salary slips
    3] Letter from your employer verifying employment
    4] I would advise carrying your last three years US tax returns.
    5] Your offer letter from the US firm you work with.
    6] If possible, a letter from the client (if you work for a consultant).
    7] Marriage certificate
    8] H1B holders passport copy with visa stamp and I-94

    Under most circumstances, they will only ask for the I-797, but if the decide to get cheeky, then all these documents will be required.

    The questions they might ask are
    1] Where does your husband work.
    2] Where will you be staying.
    3] How much salary is your husband drawing.
    4] How long do you intend to stay in the US.
    5] What do you do? do you intend to study or work in the US.

    Most of the questions will be regarding your employer and regarding you.

      I797 copy

      Thanks a lot.

      I have my original I 797. My wife in India has a photo copy of it. I hope this should be ok.

        I think a copy should be ok .. but if you have the time, send across the original 797 by overnight delivery. I did read on some post that an h4 applicant needs to have the original 797, however I don't remember sending my original 797 when my spouse had to go for her stamping.

          Original I797 of husband is not required for wife who is travelling on H4 or for visa stamping as well. A copy of it is enough.
