I was on a H1B visa with company A, but they stopped paying and wend bankrupt. I started a transfer to another company B after 3 month without paystubs. So I had nothing to show to USCIS that I was not out of status that period after they sent RFE (request for evidence).
Now my attorney says they may approve petition without COS (change of status). In that case I have to leave ASAP and get a new visa stamp. But my i-94 expires only in October.
So I'm not very clear, would it be ok to leave later but before i-94 expires? Or should I leave immediately? What is my status in that case?
