H1 not under any company

Hi,

my friend stayed in US for 1.5 years , his visa got rejected and he came to India and its been 1 year.He got good job offer from european company. so he cannot transfer h1 to this company. so if he join this company, his present employer will cancel it. so what happens to the h1b . can there be a h1b without any company owning it.
if he gets job in american company at some later point of time ,can non cap h1 be raised
