    Hi,

    I have to go for H4 stamping with my husbands copy of I 797 and mine I 539, original. He recently applied for GC process . So LCA is required? what is I129 form again?

    he says he doesn't have one since he just applied recently. pls suggest

    LCA for the visa stamping has nothing to do with the GC (Labor clearance in GC is different from LCA). LCA is required to work in U.S. The employer has to apply an LCA for every employee and it has to get approved fromthe DOL for a person to work on a particular State/City.

      My husband says he doesnt have any copy of LCA when I asked him and he says he doesnt even know what it is. Pls help!

        Ask him to check with his employer.

          Working without a valid LCA is illegal. The employer is required to file an LCA for the location that he works and get it approved for your Husband to work. Ask him to check with his employer.
