  • H1 Transfer Question

    Hello,

I had applied for a H1 transfer from company A to company B in DEC 2009 and was approved in Jan 2010. however now I got an offer from the client to join them and they would be applying for H1 transfer.

I was on vacation for 3-4 weeks outside the US while working with Company B in March 2010, hence I dont have the recent pay stub since I had no PTO left, however I do have the vacation approval from my manager and client for this period and also time sheets for the period after my vacation.

Do you guys think this could pose any issue during the transfer?

    Thanks.

When you are outside U.S, there is no status. Hence there is no need to show the pay slips. pay slips are required only for the time that you are in U.S on the H1B status. While applying for the transfer, attach required documents to support this claim (cover letter with entry/exit records from your passport, vacation letter etc).
Not a legal advice. Use of this information is strictly at your own risk.
