  • No exp letter..H1 Tranfer / Extension

    - Came to USA with compnay A and worked with company A until expiry of Visa, for 3 years until 31st July 2009.
    Applied extension through compnay A, it was denied for not submitting client letter by company A.

    - Initiated a transfer from a company B on 1st Jun 2009 through premoum processing and got approval from 1st August 2009 without any issues for next 2 years.

    - I have still 1 year left on H1.

    - Company A did not issued me experience letters for breaching non competent agreement and joining new employer.

    Note: I have all the W2's for the years I stayed in US and maintained status without gaps , filed tax returns and having all H1 documents.

    * If I want to continue working for remaining last one year,
    - What are the chances for getting RFE ?
    - What are my chances for getting another H1 transfer as I dont have previous company experience letter in US ?
    - What are my chances for getting another H1 extension as I dont have previous company experience letter in US ?
    is it better to go back to home country without applying to INS ?

    >>> Hard to predict. There will be no RFE asking for experience letters. But there could be something else, like employee/employer relationship etc.

    - What are my chances for getting another H1 transfer as I dont have previous company experience letter in US ?
    >>> Like mentioned earlier, experience letters are not required for H1B transfer.
