  • L1 to H1: H1 validity and options

    Hello,

    I am currently on L1B visa working for employer ABC. My L1 visa would be expiring by end of this year.

    My employer ABC has agreed to file a H1 for me instead of extending L1. I am trying to understand what would be the validity of H1 in following options.

    1) Supose my employer files for L1 to H1 with COS> What will be my H1 validity in this case assuming I have used up 3.5 years of my L1 but OCT 2010? Will it be 6 years or just 2.5 years with no extension?

    2) Supose my employer file for new H1 instead of L1 to H1 with COS?What would be H1 validity in this case? Will be 6 years ( 3 years and then 3 years of extension or same as above)?

    Note: I have not started my GC processing yet.
    Any response will be highly appreciated.

    Irrespective of whether the H1B is filed as a COS or consular process, the total duration of L1 + H1B is for 6 years.
