I had filed H1B in April 2008. I was asked by the sponsor to give a bank guarantee to my H1B sponsor on 1st April 2008. That bank guarantee was valid till 31st March 2010. It was for the sole purpose of guaranteeing that i'm a serious candidate for the H1B job offer and i would not leave them before one year once i land in US.
Thereafter, my sponsor filed my H1B which got successfully stamped in September 2008. Unfortunately the sponsor made me resign from my job in March 2009 but later on retracted from its promise citing US recession as the reason. I suffered but kept quiet.
Now all of a sudden in January 2010 he withdrew the bank guarantee amount, which was significant, and did not even inform me before that.
Now upon asking them why they withdrew it they say that you delayed your going to US even though we were willing to send you.
Please guide whether what legal action can i take against them if any.
