Mr X was employed with A in india and then switched to B. B send the X to USA on H1b visa. X got the rehire offer letter from A and he joined the A after H1b transfer approval. Now in first week, A is saying that he can’t give employment to X due to some code of conduct in previous employment and his rehire is closed and he have to leave. Is it legal? Didn’t they have to check before giving the offer letter? X have already resigned from B and joined A as per the offer letter date. What options X have now.
