Hi,
I am currently on H1 visa (with a non profit organization which does not come under the cap) and have been laid off from my job . My employer has said that he is going to cancel the visa on Dec 30th. So technically I will be
out of status as of Dec 30th.
As such I would like to maintain my legal status in the country. If I apply for B2 visa (visitor) between Dec 20th & Dec 30th, will I be considered to be in status as of the date my application is received by the INS? or only after I receive the receipt will I be considered to be in legal status? Please let me know how does this work. Any help is highly appreciated.
