    Hi All,

    I am in India. I was working for Company A in India. My h1b visa was stamped around an year back and is valid till end of 2011, my employer was Company B, they have office in US and India(I have never worked for Company B). so far they couldn't find at least one opportunity, I am tired talking to them. I have never been to USA or any other country so far.

    Right now I am working for Company C in India itself, Company C is asking for the h1b transfer. I have the I797 petition copy with me. Shall I go ahead and do h1 transfer, is it allowed and its legal? Would there be any problems in the future?

    But based on my research for h1 transfer payslips from company B is required, which i don't have (since I never worked for them).

    Please clarify my questions.

    Possible. Company C will have to file a new H1B petition on your behalf under the same CAP (Just give them a copy of your existing H1B approval notice). Pay slips are required only if you have already worked on H1B.
