I will be changing my employer in August 2020. So I will have my new H1B by then.
My wife and daughter has the old H4B visa stamp in their passports which expires in May 5, 2021 and Sep 16, 2021 respectively.
We are planning to go to India next summer (2021) and apply for new H4 visa in their passports via consular processing.
In that case, is it OK NOT to submit 539 for my family while I do my new H1B transfer?
That means, can they stay on-H4-status in USA even after August 2020, with old I-94 (expires on May 2021 and Sep 2021) and visa (same expiry as I-94) in their passports ?
Also, can my wife (I-94 expires on May 5 2021) extend her I-94 later separately - after August 2020 ?
