Kindly answer this H1 transfer scenario:

Scenario:
The company B acquired company A. But the consultants did not get any updated I 797 with company B's name. Company B circulated an email/memo saying there is no need because B has acquired company A completely. All employees of A are now getting company B's pay stubs but have I797 on company A's Name.

Question:
1. Can a consultant transfer H1B from company B to a new company C if he has the photo copy of I-797 of company A ( along with recent 2-3 months paystubs from B) ?
2. Would immigration raise any RFE in this kind of transfer? If yes, what he proactively can do to ensure that he doesn't face any problem in this transfer?
