  • L1 to h1

    Hi,

I came on L1 to U.S thru company A. But I have an approved H1 petition from company B. Will I be able to take a full time job and join with company C ??

If so what should company C do for me? Will company C be able to transfer the H1 ?? even though I am on L1 status?/

Please let me know the options I have to take up a full time job ..

C has to file for H1 as CoS (change-of-status) so after approval you can work for C.

But my H1 is on company B's name. Still can company C file for COS???
If they do it will the H1 be transferred to the company B's name??

or should company C should apply COS as well as transfer of H1.

I do not have any paystubs on H1 as I havenot worked with company B.

I have only L1 company paystubs.

        Read carefully.

I said C has to file for H1.
It's H1 transfer. Transfer is nothing but new H1 except that you're cap-exempt.

Why do you need pay stubs of B? Did you work for them?
You want to be paid even if you didn't work?

          Thanks for the response...

This year the cap is still not over...So should I ask the company C to file for a new H1 or H1 transfer??

It doesn't matter if cap isn't full.

H1 Under cap - start date Oct 1 or later.
H1 exempt from cap - start date immediate.
This is my opinion and not legal advice.
